General Terms and Conditions

Scope

These General Terms and Conditions apply to Subapet GmbH. Email: info@subapet.com ("Subapet"). It is valid for the Subapet online store operated by it at https://www.subapet.com. Deliveries, services and offers of Subapet GbmH are carried out solely on the basis of these terms and conditions. The terms are deemed to have been accepted when you order goods or services. The buyer's general purchase conditions are contradictory here. Deviations from these terms and conditions must be confirmed in writing.

Signing the Offer and Contract

Subapet GmbH's offers in price lists and advertisements are subject to change and are not binding. Orders will only be finalized upon approval by Suba GmbH. Deliveries are only made to addresses in Switzerland and Liechtenstein. The information in our sales documents (drawings, images, dimensions, weights and other services) should be understood as a guide only and does not constitute a guarantee for non-mutually approved specifications. If the buyer exceeds the credit limit on his order, we are exempt from our delivery obligation.

Pricing

The prices stated in our order confirmation are decisive. These are fixed for items in stock at the time of order. For deliveries, the price on the day the order was placed is valid. Unless otherwise agreed, prices exclude shipping costs and include VAT.

Delivery and service time

Dates and delivery times are not binding unless otherwise transparently agreed in writing. Specific delivery times and delivery dates specified by Subapet GmbH are subject to correct and timely deliveries to Subapet GmbH by suppliers and manufacturers.

 

Default on Acceptance

If the orderer declares acceptance of the delivery items after the grace period has expired and does not wish to accept the goods, Subapet GbmH may refuse to fulfill the contract and claim compensation for non-fulfillment. Subapet GmbH is entitled to demand from the buyer a flat rate of 25% of the agreed purchase price or compensation for damages.

Delivery

Noticeable differences in quantities must be reported to Subapet GmbH in writing immediately upon receipt of the goods; Hidden differences in quantities must be reported to Subapet GmbH in writing within 4 days of receipt of the goods. Complaints regarding damage, delay or loss must be reported immediately upon receipt of the goods.

Deliveries are made only within Switzerland and Liechtenstein.

Unless stated otherwise in the offer, delivery time is 2-4 business days. Delivery time starts the day after the contract is established, excluding prepayment. If the last day of the delivery deadline falls on a Saturday, Sunday or public holiday at the place of delivery, the period is automatically extended until the next business day.

You can find information about delivery and shipping conditions here. If all ordered products are not in stock, Subapet will immediately refund the payments already made by informing the customer.

Delivery within the EU is duty free. The customer is responsible for any customs duties, taxes and other fees that may occur when delivering to countries outside the EU.

In order to fulfill orders in the best possible way and to best inform our customers about the shipping status, Subapet sends the email address and - if available - the customer's phone number (in the case of transport deliveries) to the relevant delivery companies. Subapet sees both its customers' interests and its own interests in a balanced relationship, especially since delivery companies are extremely committed to protecting personal data and use data only for shipping information. Responsibility

The risk is transferred to the buyer upon delivery of the shipment to the person carrying out the transportation. If shipment is delayed or becomes impossible due to no fault of ours, the risk passes to the buyer upon notification that shipment is ready. Subapet GmbH's agreed assumption of transport costs in some cases has no effect on the transfer of risk.

Guarantee

Unless otherwise expressly agreed in writing, the warranty is 2 years in accordance with the following provisions. The warranty period starts on the delivery date. Any warranty will be void if the defect is attributable to failure to comply with our operating or maintenance instructions, modifications, replacement of parts or use of consumables that do not conform to the original specifications. This also applies if the defect is caused by improper use, storage and transportation of the devices or by external intervention or opening of the devices. Insignificant deviations from the guaranteed characteristics of the goods do not give rise to any warranty rights. Liability for normal wear and tear as well as consumables/accessories is excluded. Warranty claims against Subapet GmbH are directed solely to the purchaser and are non-transferable.

Medications should only be used as recommended and under the regular supervision of your veterinarian. A veterinarian should be consulted regularly for checks during use and immediately if the pet's health deteriorates. Subapet GmbH accepts no liability for the consequences of improper or medically inappropriate use of medicines.

Return

You can return your orders within 14 days. Please notify us of the return in advance via email (info@subapet.com). We will check this and you will be notified via email about the correct return address and next steps. You can receive the refund in the form of a coupon or cash. Please send an e-mail with your full address in which way you would like to receive it. We also need the order and item number, as well as the quantity and reason for return. You can return the product you purchased unused, in its original packaging or in a sturdy box, within 14 days from the date of receipt. If your delivery contains a faulty or defective product, postage costs will be covered by Subapet GmbH. Otherwise, postage costs incurred must be covered by the customer. You will receive a free receipt from the post office when you return your package. Please keep this in a safe place because in the event a package is lost, your return shipment can only be credited upon presentation of this receipt. The purchase price will be refunded to the customer upon receipt of the goods. Please note that additional fees may apply depending on the payment method you choose.

Retention of property

The products remain the property of Subapet GbmH until full payment is made. It is prohibited to pledge, transfer as security, process or redesign without Subapet's permission before the transfer of ownership.

Payment, Invoice, Debt and Coupons

A. Payment We offer the following payment options;

Payment by credit card, Cash payment, Payment via PayPal, Payment via ApplePay, Payment via Twint. We reserve the right to not offer payment methods or only accept certain payment methods and resort to other payment methods. Payment by cash or check is not possible and Subapet GmbH is not liable for any damages.

 

-Credit Card (MarterCard and Visa)

When paying by credit card, the charge will be made within one week after the goods are shipped. It is possible to choose between VISA and MasterCard.

 

-Advance payment

If the customer wishes to make an advance payment, the invoice amount must be transferred to one of the accounts listed below or in our service e-mails within 7 days from the receipt of the payment information. Goods will be sent only after payment is received. If you do not send full payment within seven days of receiving this payment information, we will cancel your order. You pay directly through your PayPal account. After submitting your order you will be redirected to PayPal and leave the order value there. As soon as your confirmation is notified to our PayPal account, shipping will be carried out depending on the delivery time specified for the product. You can receive discounts, gift certificates, etc. from your PayPal account immediately after authorization. The actual invoice amount will be collected after deduction.

Payment via ApplePay

Apple Pay is available as a payment method for iOS devices in our app and mobile web store. After you submit your order, you will be directed to Apple to authorize payment for the order value. As soon as your confirmation is notified to us, shipping will begin, subject to the shipping time specified with the goods. Depending on the payment method stored in Apple Pay, discounts, coupons, etc. may be deducted from the actual invoice amount. deducted will be collected immediately after payment is sent.

 

Payment via Twint

When paying with TWINT, after submitting your order in the Fressnapf online store, you will be redirected to the payment service provider TWINT, where you can authorize payment of the order amount. To do this, you must be registered with TWINT and have a bank account linked to your account. Payment will be made automatically by TWINT immediately afterwards. You will receive more information during the ordering process.

B. Invoices

Subapet GmbH has the right to invoice the customer electronically. Electronic invoices are sent to the customer via email in PDF format. Sales tax invoiced does not entitle you to deduct input tax. ​

 

C. Interest on overdue debts and other losses resulting from default

If the customer defaults in payment, interest will be charged on the purchase price at the legal default interest rate for the duration of the default. Subapet GmbH reserves the right to demand higher compensation in case of default if proven. ​

 

D. Coupons

The use of coupons depends on the relevant coupon's minimum order quantity, minimum order value, validity period, etc. It depends on the special payment terms such as. Only one coupon can be used per purchase. This cannot be combined with other discounts. Cash payment or subsequent offset against previous orders is not possible. Resale is not allowed. Discounts on returns will be offset in proportion to the value of the return.

Responsibilities

Claims for damages arising from impossibility of performance, breach of contract, negligence in concluding the contract and unlawful acts are excluded both against us and against our vicarious agents or vicarious agents, unless there is an intentional or grossly negligent act. No liability is accepted for consequential damages arising from the use of the products.

Marketing and Communications

If the customer makes a contract with Subapet GmbH to purchase a product or service and provides his e-mail address, Subapet GmbH may use this e-mail address for direct advertising and marketing of similar goods or services. The customer has the right to object to the use of his e-mail address for this purpose at any time. For this purpose, every email contains an unsubscribe link. It can also be reported at any time via email to info@subapet.com.

Subapet GmbH Subscription

-General

Subapet GmbH subscription allows customers to place automatic orders for suitable products at regular intervals. Temporary promotional products are not included in the subscription.

Orders that are confirmed or completed and contain products suitable for subscription can be converted to subscriptions in the "My Orders" section of the customer account.

Each automatic order as part of the subscription represents a binding offer to conclude a purchase contract for Subapet GmbH. The contract with Subapet GmbH is concluded only when Subapet GmbH ships the ordered product to the customer and the shipment is confirmed to the customer by another email within five business days. Automatic from receipt of the order (shipping confirmation). If the customer cannot receive cargo confirmation within the above-mentioned period, no contract will be made with Subapet GmbH. Before an automatic order is processed, Subapet GmbH sends the customer a reminder email, allowing him to cancel or modify the order.

-Subscription discount

Subapet GmbH provides a subscription discount on the regular, current price of special items. You can find information about the discount amount and products suitable for subscription on the "subscription information page". The subscription discount the customer receives is the discount valid for subscription products at the time the order is processed. Certain details of the subscription and product (including price, discounts and availability) may change over time. Each Subscription order is subject to the then-current Subscription and Product Details. Subapet GmbH therefore reserves the right to change the subscription discount at any time. Subscription discount cannot be combined with other discounts.

-Product availability

If an ordered product is not available on the scheduled delivery date, the order for this product will be automatically cancelled.

-Term, Changes and Termination

There is no minimum duration of the subscription. Delivery intervals can be freely selected in weeks but must be a minimum of two (2) and a maximum of ten (10) weeks. Subscription changes, interruptions and cancellations are possible at any time from the “My Subscriptions” section in the customer account. Subapet GmbH may change these subscription terms at any time by publishing the changed terms on subapet.com and informing the customer in advance in case of significant changes. By continuing to subscribe, the customer accepts these changes. If the customer does not accept any changes to these terms and conditions, he must cancel his subscription. You can find more information on how to cancel your subscription here. Subapet GmbH has the right to terminate the contract at any time, in writing or without giving any reason.

 

-Payment methods

Payment for products ordered under the subscription can only be made by credit card or PayPal. A prerequisite for payment via credit card and PayPal is that the data in the customer account is up-to-date and complete.

 

-Other

If any provision of these Terms, as amended, is deemed invalid, void or for any reason unenforceable, this will not affect the validity and enforceability of the remaining terms and conditions.

Subonus - Subapet bonus program

When the customer registers and creates "My Subapet account", just like his first order, he automatically gets the right to participate in the Subapet bonus program free of charge. You can find the details of the participation conditions here.

Consumer dispute resolution

The European Commission offers a platform for online dispute resolution (OS) between entrepreneurs and consumers, which you can find here: www.ec.europa.eu/consumers/odr . We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

Applicable Law | Jurisdiction

For the legal relationship between subapet.com and the customer, Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If a provision of these General Terms and Conditions is invalid, the remainder of the agreement remains valid.

For natural persons, the place of jurisdiction is the registered office of Subapet GmbH or the place of residence of the customer. For legal entities, the registered office of Subapet GmbH is the exclusive place of jurisdiction.
